To an extent, it very well may be.

If 45 republicans see it as unconstitutional, then I don't see much in the trial changing anything. We already know that democrats convicted him in this trial like 4 years ago.

Lindsey Graham: Outcome of the Impeachment Trial ‘Really Not in Doubt,’ Will Result in an Acquittal

Sen. Lindsey Graham (R-SC) repeated the sentiments of his GOP colleagues on Sunday and explained the outcome of the Senate impeachment trial against former President Donald Trump, which is slated to begin Tuesday, is “really not in doubt.” He predicted it will result in an acquittal as Democrats appear to lack support from enough Republicans to convict him.

Graham made clear he does not intend to convict Trump in the Senate impeachment trial despite initially referring to the January 6 event as “a self-inflicted wound.”

“It’s not a crime. I mean, the House is impeaching him under the theory that his speech created a riot,” he told Face the Nation’s Margaret Brennan on Sunday. “When you look at the facts, many people had already planned the- to attack the Capitol before he ever spoke.”

Brennan referred to the trial memo, which contends that the former president’s pattern of behavior, particularly casting doubt on the results of the 2020 presidential election, led to the siege of the Capitol.

“Yeah, well, here’s what I would say, that if you believe you committed a crime, he can be prosecuted like any other citizen. Impeachment is a political process. We’ve never impeached a president once they’re out of office,” Graham said, calling it a “very bad idea.”

“Forty-five plus Republicans are going to vote early on that it’s unconstitutional,” he said, referencing Sen. Rand Paul’s (R-KY) motion. “It’s not a question of how the trial ends. It’s a question of when it ends.”

“Republicans are going to view this as an unconstitutional exercise. And the only question is, will they call witnesses? How long does the trial take? But the outcome is really not in doubt,” he concluded, emphasizing that he is not condoning what occurred at the U.S. Capitol that day as lawmakers gathered to certify the electoral vote.

“That doesn’t mean what happened on January the 6th was okay. It means this impeachment, in the eyes of most Republicans, is an unconstitutional exercise,” the South Carolina lawmaker said.

They're not going to quit going after Trump. He's a threat so long as his record remains clean. Don't know why that matters given the records of some Dems, but it will for him. They have to disqualify him from running again.

I wonder why nobody mentions that this post-office impeachment efforts boils down to a distrust for the American voter. Voters can prevent Trump from returning to politics.

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors

ARTICLE I SECTION 3 Clause 6 and 7

3.6 The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

3.7 Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

This impeachment, the phony election, the riots, the cancel culture are all symptoms of a disease that has one cure. Public officials need to be arrested, tried and convicted then sent to prison.

I can think of several senators, congresswomen, a congressman, a former Secretary of State, and a sitting President who should be facing trial.

We are a country of laws, but laws don’t mean anything if they are not enforced.

Yet as lawless as these arrogant vermin are- they may attempt --anything-- despite the obvious.
The reality- the truth is these ffing people have no integrity, no shame, no respect for law and order, no respect for justice and most certainly
absolutely no respect for the Constitution of the United States of America!
Those leading this stupidity should be in jail , imho.
Should definitely be removed from office--as they abrogate their sworn oath of office.
And this crap has long ago went far, far far beyond the limit that it should have been allowed to step.
The hatred of these assholes is a shame to this nation..
The fact that these ffing buffoons get to prance around and lie and be absolutely dishonorable reprobates is in itself mind-boggling to behold..
