The Justice Department has reportedly granted immunity to a former State Department staffer who worked on Hillary Clinton’s private email server.


A senior U.S. law enforcement official told The Washington Post (https://www.washingtonpost.com/world/national-security/in-clinton-email-investigation-justice-department-grants-immunity-to-former-state-department-staffer/2016/03/02/e421e39e-e0a0-11e5-9c36-e1902f6b6571_story.html?hpid=hp_hp-top-table-main_clintonemail830p%3Ahomepage%2Fstory) on Wednesday that the FBI secured the cooperation of Bryan Pagliano, who worked on Clinton’s 2008 presidential campaign before setting up the private server at her New York home in 2009.


Current and former agents told the newspaper that agents will likely want to interview Clinton and her senior aides about the decision to use a private server, and whether any of the participants knew they were sending classified information in emails as part of the ongoing investigation.


Republican presidential candidate Sen. Ted Cruz of Texas called the latest developments on the Clinton investigation "ominous" in an interview with Fox News' Megyn Kelly on "The Kelly File," and that it meant the process was moving to "a whole other level."

The FBI has been asking for Pagliano's cooperation for months as dozens of investigators pored over thousands of Clinton emails in a secure room on the fourth floor of FBI headquarters.





The probe shifted into a new phase recently as investigators completed the review of the emails, working with intelligence agencies and the State Department to determine whether they were classified.

"As we have said since last summer, Secretary Clinton has been cooperating with the Justice Department's security inquiry, including offering in August to meet with them to assist their efforts if needed," said Brian Fallon, a spokesman for Clinton's presidential campaign.


Fallon added that the campaign was "pleased" Pagliano was cooperating with the Justice Department.


Last fall, when Pagliano invoked his Fifth Amendment rights (http://www.cnn.com/2015/09/03/politics/clinton-aide-fifth-amendment-emails/) and declined to talk to congressional investigators, Fallon said: "(Clinton has) encouraged everyone to cooperate because we want to make every good-faith effort to be transparent and answer any questions people have. With Mr. Pagliano, we encouraged him as well because we don't think he has any reason to not be transparent about the help that he provided from an IT perspective, but unfortunately, it is his choice what to do."


A message left with Pagliano's attorney was not immediately returned.


With the completion of the email review, FBI investigators are expected to shift their focus on whether the highly sensitive government information, including top secret and other classified matters, found on Clinton's private email server constitutes a crime.

It'll be interesting to hear how he had to explain how the two email systems are physically separate and the solutions to get around that.

More importantly, I'm sure that Hellary's desire to be able to delete emails to protect herself from FOIA requests was discussed in depth - that had to have been the driving force behind the entire project in the first place.

I'd wager my last dollar that she's regretting not taking a hammer to the server's hard drives now. Stupidity defined!

Totally Nixonian.

Bottom line is this points that it's moving towards criminal stage. FBI turned it over to DOJ who had to go to federal judge to get immunity deal approved. Now that it's accepted by Pagliano, he must stay within the agreement on what he testifies to.

This wouldn't be out there, without approval.

Oh, Cheryl... what have you done?

Seeing Billy Bob get indicted as he acted on classified intel to make a buck will be the cherry on top.

Anyone think Lynch will prosecute? Anyone think she'd offer ANYTHING resembling a solid prosecution? If she does it will be symbolic in nature and Hillary will be easily exonerated.

I honestly don't know. She hasn't blocked the DOJ from going to the judge. Won't stop a pardon, but that would likely deny her nomination.

If she has any kind of personal ambitions she will. 2 years as an AG puppet won't make her rich & famous, but has all the potential to make her synonymous with government corruption.

True. I did notice she pretty much batted away the whole SCOTUS consideration, smart people are going to stay out of that. She may be more savvy than thought.

Getting back to Pagliano... he's pretty young and may not know about people such as Vince Foster.

I wonder if the FBI has him in protective custody? At the very least he should stay away from tall buildings, cars, airplanes, boats, garbage disposals, can openers... you know, the usual murder utensils for Clinton insiders who start talking to persuasive LEOs who are sniffing about.

EXCLUSIVE: The FBI is investigating whether computer passwords were shared among Hillary Clinton's close aides to determine how sensitive intelligence "jumped the gap" between the classified systems and Clinton's unsecured personal server, according to an intelligence source familiar with the probe.


The source emphasized to Fox News that “if [Clinton] was allowing other people to use her passwords, that is a big problem.” The Foreign Service Officers Manual prohibits the sharing of passwords.


Such passwords are required to access each State Department network. This includes the network for highly classified intelligence -- known as SCI or Sensitive Compartmented Information -- and the unclassified system, known as SBU or Sensitive But Unclassified, according to former State Department employees.


Fox News was told there are several potential scenarios for how classified information got onto Clinton’s server:




Reading intelligence reports or briefings, and then summarizing the findings in emails sent on Clinton's unsecured personal server.
Accessing the classified intelligence computer network, and then lifting sections by typing them verbatim into a device such as an iPad or BlackBerry.
Taking pictures of a computer screen to capture the intelligence.
Using a thumb drive or disk to physically move the intelligence, but this would require access to a data center. It’s unclear whether Clinton’s former IT specialist Bryan Pagliano, who as first reported by The Washington Post has reached an immunity deal with the Justice Department, or others had sufficient administrator privileges to physically transfer data.


Most of these scenarios would require a password. And all of these practices would be strictly prohibited under non-disclosure agreements signed by Clinton and others, and federal law.

Was stopped behind car today that had a "Carson For President 2016" on the back. But then I saw this thinking they were advocating for Hilary for President as well, and for a moment experienced some cognitive dysfunction until I read the fine print, and then saw the NRA sticker ...... and then I just wanted to go home and give the guy a kiss! I love living in Tucson ....

I think the Immunity was by far the biggest story of the day, but it seemed lost in all the coverage of the Trump/Rubio shenanigans.
