Should a child be charged with manslaughter?


A judge has ordered a mental competency exam for an 11-year-old Detroit boy who is charged with manslaughter in the fatal shooting of a 3-year-old boy.


The boy is charged in Juvenile Court with manslaughter without malice, as well as using a firearm during a felony.


Police say the older boy took a handgun from a closet at his father's home last week and tossed it from a window into the yard. Police say he retrieved the gun and fired it, striking 3-year-old Elijah Walker in the face.

Unless he is extremely advanced and/or brought up in an violent family, there is no way an 11 year old has the thought process to know what he is doing in this case.
The adult owners should be charged with making a firearm accessible to a child.

There is another case out there where two 13 years old are being tried as adults. Which is stupid as hell. You try them as juveniles and have them re-sentenced when they are adults.

If a juvenile commits premeditated murder, the death penalty should be an option. Why give him or her an opportunity to kill more people?
