“After five minutes of talking to you in pre-op,” the anesthesiologist told the sedated patient, “I wanted to punch you in the face and man you up a little bit,” she was recorded saying.



There was much more. So the man sued the two doctors and their practices for defamation and medical malpractice and, last week, after a three-day trial, a Fairfax County jury ordered the anesthesiologist and her practice to pay him $500,000.


The fact that so many people in this comment section say this is common behavior just shows how widespread it has become.

Should she have been sanctioned and/or fined for her comments and falsifying information? Yes. Forced to pay the patient $500,000 for jokes in poor taste? No.

I don't buy he turned on his recorder to get post-procedure instructions. I suspect he turned on his recorder to hear what they were saying about him. And it paid off handsomely. Convenient, wasn't it? He didn't just hear what they were saying, he went to a lawyer to see how he could profit from it.

Think about it. You make fun of someone. That person finds out. You then have to pay 1/2 million dollars. Ridiculous.

Although it is very unprofessional I have to agree, to have to pay someone for talking about them is crazy, now the fact they gave him the wrong diagnosis, well that should be punishable by jail IMO, but just talking trash, tacky yes, against the law, I don't think it should be.

Nutshell version:

The patient was a jerk, alienating people upon meeting people he had to deal with. He KNEW he alienated them, thus wanted proof.

There should be punishments for falsifying his reports, but calling a jerk, 'a jerk' is how we don't go around punching every jerk.

I hear what you are saying, but Gabs and her Husband work hard for their money, I don't feel I have any right to it, not for one of those BS law suits. Just my opinion but I can't stand those law suits or the people that think they are going to get rich getting them, I have watched so many get awarded money for lies, and yea they get 50 or even 100 grand and in a years time they are broke and wondering what happen to the money. Now if you earn that money you respect it and you know what you are doing with it because you worked hard for it, the old saying easy come easy go does apply.

I know you think that being litigious is admirable, but to a honest hardworking American, it is not. I think it's despicable. It should only be pursued when other courses of action are ruled out.

This guy was looking for a payday, and he set this Anesthesiologist up after being a dick & winding her up prior to going under. He's actually fortunate that she didn't accidentally give him too much after he pissed her off.

Besides that, since when does her opinion of him become a liability? She doesn't have the right to have her own opinions? She has no freedom of speech?

The jury got it wrong and he should have been liable for all court costs.

My family was involved in an accident with a drunk & drugged driver with 3 buddies in his car that ran a stop sign, tried making a right and hit my family head on. Their lawyers sued everyone, and I mean everyone. The farmer who's property the stop sign was on, Penndot, the Township, my Mom, others that I don't remember, just basically anyone with insurance that they could try to blame.

They had no case with the underage driver drunk, car filled with alcohol & drugs plus running the stop sign & speeding. It was settled out of court for what at that time was the 2nd largest settlement in Pennsylvania history, a high 7 figures
I hate insurance companies for settling frivolous cases and the lawyers that profit from it.

The drill is if I don't like what you say or how you say it, I'll sue. We have plenty to say about these idiots. We're usually smarter than this doc was. And trust me, her comments were mild. We just make darned sure that we are not heard. And when we deal with the public, we put on our Stepford smiles.

I disagree, Wiccan. I like most of my patients and always have. It is the interaction with patients that I love in Nursing. But there is a certain percentage, maybe 10%, that make me figuratively want to pull my hair out.

I try, but there is always a small percentage of people who are simply difficult. They know they are difficult and they think it is clever and cute, or they just don't care how they act.

I try to understand that people are sick and in need.

I've always agree with "people don't have a right to not get insulted". And in today's world, we apparently are getting to say less and less and less and less. And then when you do, you get charged with a crime or found to pay monstrous damages. How was THIS guy damaged? He wasn't. And he won a ton of money simply because today's crappy world thinks we shouldn't be able to speak our minds, that we should coddle everyone and kiss their asses and make them feel all bright and sunny.

Only a matter of time before Jafar's wish comes true, and we start getting fined if we insult someone else. Imagine, driving down the road and a reckless driver cuts you off. At the next light, most of us anyway, will either tell him our thoughts, or express it via a one finger salute. BAM! $60 fine, can't be insulting others!!

2. I always have to leave all of my belongings in a separate room from my (hopefully) somewhat sterile procedure. Where did this guy hide his cell phone? I know he wasn't wearing a lot of clothing, lol.

I wondered a lot of the same things. While a colonoscopy is not done in a sterile environment, it would be unusual to undress in the room where the procedure is being done. Like you, I suspect a lot foul here.

What about those of us that hold out until we're so sick we can hardly walk to go into your facility so we can be treated like shit, and a number?

I don't want to sue you nor anyone else. But when someone's in pain how about some pain killers? The fact is, you let the idiots that abuse the system control how you treat those who are actually in need. And by God don't ask for what works. You'll get everything but that.

I'm not a number, I'm a person. I get up in the morning and put on a knee and an ankle brace so I don't stumble around the house. Apparently 3-5 miles a day running only works as long as the Government. And people are questioning why cops act like they do?

I have seen patients with amputations given little pain medication, while drug addicts are given tons. I have never understood it.

Your population may be different than the ones I deal with. This week we have had at least a half dozen walk ins. These patients come in for a procedure when their doc asks if they can be fitted in. They then begin to complain that they have to wait and raise a ruckus in the waiting room and the hallway and, in one case, decided to just leave. This adds to the ones who come in three hours early thinking they will be seen sooner and insist they are supposed to go to the head of the schedule. There are the inevitable losers who do not understand that the phrase 'Nothing by mouth" does indeed mean absolutely nothing including water and coffee. I have had a patient walk out to the park and tell us he had to go smoke a joint. At least a dozen this week have denied any medical problem and when you ask what meds they are on they begin to list their HIV cocktail. And there are at least five a day who lie to us when we ask about an escort to take them home after they have had sedation and get angry with us when we insist on calling the person to confirm their willingness to do so. Oh and I do so love getting my pockets picked by the "medicaid" patients. People who did a largely cash business and report themselves as impoverished to qualify for benefits when they are wearing serious gold jewelry and drive a Porsche and live in a million dollar condo. In short the protoplasm here is of a very low quality. The nicest patients I have had all week were the ones today as the MD I was working with has a developmentally disabled client base. They can be emotionally challenging but they react to the world in the only way they are capable of.

Yes dear, my population IS different from what you have. But I am aware of exactly the type of people you are talking about. I had many of that type in ER.

One of the scariest nights of my life came a couple of years ago. My daughter was spending the weekend with my sister and her husband at their home in East Los Angeles. My daughter had a reaction to something she ate and my sister took her to the emergency room.
Saturday night at an emergency room in East Los Angeles is quite an experience. There were gunshot wounds, serious burns, broken limbs and who knows what else. I felt great respect for the nurses and other hospital staff. They gave everyone the same level of care.
Most ER staff there run 12-hour shifts. Not sure if that is common practice or not. Some of the doctors are on 24-hour call. I can imagine being exposed to that level of trauma for 12 or more hours at a time.

What is it with you and v4R and your false assumptions? When my family goes for emergency healthcare, we make it a point to be as forgettable as possible. It sometimes makes the difference between whether or not they turn it over to a collection agency when you don't pay the bill. I know how to deal with collection agencies, but it's best when the bill isn't collected in the first place.
