rosecutorial and police misconduct are often dismissed as just a few bad apples doing a few bad apple-ish things. But what happens when it’s entrenched and systemic and goes unchecked for years? That looks to be the case in Orange County, California, where the situation got so completely out of hand this spring that Superior Court Judge Thomas Goethals issued an order disqualifying the entire Orange County District Attorney’s Office (http://www.latimes.com/local/orangecounty/la-me-jailhouse-snitch-20150313-story.html) (that’s all 250 prosecutors) from continuing to prosecute a major death penalty case.

Together with his law clerks, Sanders spent a year unearthing and then reconstructing a tranche of 60,000 pages of records indicating that the country sheriff’s office routinely used and coordinated with those informants to get around the constitutional prohibition on eliciting incriminating statements from defendants who had lawyered up and should not have been interrogated. The sheriff’s department has admitted that mistakes were made. The DA’s office claims there was nothing coordinated or systemic going on. But Judge Goethals disagreed, finding that the new revelations called into question the integrity of the entire Orange County District Attorney’s office (http://www.prosecutorialaccountability.com/ca-judge-removes-das-office-in-orange-county-murder-case-because-office-will-not-comply-with-constitution/).

Initially, Judge Goethals had ruled that the DA’s office was negligent in failing to turn exculpatory information over, finding that “the district attorney’s well-documented failures in this case, although disappointing, even disheartening to any interested member of this community, were negligent rather than malicious.” But that seems to have changed following further revelations of refusal to turn over evidence.

In an explosive moment following a hearing last year, Sanders revealed that the Orange County Sheriffs Department has maintained a massive, secret, 25-year-old computerized record-keeping system called TRED. These TRED documents were full of potentially exculpatory data, but the agency officials had systematically refused to turn any of them over, or even acknowledge their very existence, to defense counsel.

In his March order (http://www.prosecutorialaccountability.com/wp-content/uploads/2015/03/SUPPLEMENTAL-RULING-03-12-2015.pdf), Goethals wrote: “It is now apparent that the discovery situation in this case is far worse than the court previously realized. In fact, a wealth of potentially relevant discovery material—an entire computerized data base built and maintained by the Orange County Sheriff over the course of many years which is a repository for information related directly to the very issues that this court was examining as a result of the defendant’s motion—remained secret, despite numerous specific discovery orders issued by this court, until long after the initial evidentiary hearing in this case was concluded and rulings were made.”

that's horrific. it's bad enough that's the county was doing it. but that they did it systematically and kept computer records for 25 years. And failed to turn the records over after judges and investigations are on going. that's 3rd world level corruption.

It just terrible.
The thing about this that bothers me on a pragmatic level is this.
There are real crimes committed on the streets everyday. WHY push the innocent or "not as guilty" offenders through the system?
the only reasons that come to me are a mix of career advancement, laziness, prejudice, quotas and stats.

Here's an idea that may get me a medal or get me shot down but here goes. Corruption in any branch or level of government becomes entrenched because of bureaucrats, not the politicians themselves. Because the bureaucrats are there no matter which party is in power. And their interest is in seeing that the status quo goes on as it has previously. Someone new comes into office. They discover something that seems off but are simply told that the system runs that way. They gradually begin to buy into that system because things do seem to run smoothly and that makes the general voting public happy. Because, as much as the vocal sort like us on the board would like to think otherwise, the vast majority of people, regardless of stated politics, are SHEEP. What they care about is adequate feed and minimal wolves. We look at an instance and say it's that party. Yet we find wells of corruption existing for years in various municipalities for years and those supposedly in power are of either party. Yet when something like this comes up, everyone is shocked. Maybe I am becoming an anarchist in my old age. Maybe the only answer is to tear it all down and start from scratch. Problem is I am way too tired to lead the revolution. Anyone else want to volunteer?

Here's an idea that may get me a medal or get me shot down but here goes. Corruption in any branch or level of government becomes entrenched because of bureaucrats, not the politicians themselves. Because the bureaucrats are there no matter which party is in power. And their interest is in seeing that the status quo goes on as it has previously. Someone new comes into office. They discover something that seems off but are simply told that the system runs that way. They gradually begin to buy into that system because things do seem to run smoothly and that makes the general voting public happy. Because, as much as the vocal sort like us on the board would like to think otherwise, the vast majority of people, regardless of stated politics, are SHEEP. What they care about is adequate feed and minimal wolves. We look at an instance and say it's that party. Yet we find wells of corruption existing for years in various municipalities for years and those supposedly in power are of either party. Yet when something like this comes up, everyone is shocked. Maybe I am becoming an anarchist in my old age. Maybe the only answer is to tear it all down and start from scratch. Problem is I am way too tired to lead the revolution. Anyone else want to volunteer?

The Real Reason For Federal Corruption

This week, FBI and IRS agents searched the home of Senator Ted Stevens, R-Alaska, 83. Stevens is under suspicion for his connection to Bill Allen, an oil state-services contractor convicted of bribing Alaska state lawmakers. Stevens has served in the Senate for almost three decades.

The Stevens investigation comes hot on the heels of the Rep. Duke Cunningham, R-California, scandal, in which Cunningham pleaded guilty to taking bribes from defense contractors; the Rep. William Jefferson, D-Louisiana, scandal, in which federal agents found $90,000 in cash stuffed in Jefferson's freezer; and the Jack Abramoff scandal, in which Abramoff was connected with lawmakers from both the Republican and Democratic parties.

For years, we've heard that there's too much money in politics. That mantra was the motivating force behind anti-First Amendment campaign finance reform legislation.

The latest scandals only seem to lend heightened credence to such a critique. Surely congressional corruption has something to do with the money floating around Washington, D.C.

Congressional corruption does have something to do with the money floating around D.C. — but the problem isn't the general public's political expenditures. Americans have always spent money on politics, but it is only within the last century that the federal government became a significant repository of corruption.

The question, then, isn't why there's governmental corruption — there has always been and will always be governmental corruption. The question is why that corruption has shifted from the local level to the federal level.

And the answer is simple: The increased role of the federal government opens the door to federal corruption. As long as the federal government spends millions of taxpayer dollars on purely state and local projects, lobbyists would be fools to stay away. As long as the federal government spends cash on bridges to nowhere and structures named after senators, political interest groups will lurk in the shadows, offering pay-for-play.

Federalism once insulated the federal government from petty monetary corruption — states were the big spenders.




The Founders believed, rightly, that the limited powers of the federal government, combined with the broader electorate for the federal government, would circumscribe corruption at the federal level.
Until the time of FDR, the Founders' guardrails against federal corruption remained effective. State corruption was exponentially more prevalent than federal corruption. State legislators could offer their constituents subsidies, local projects and jobs. The federal government could offer patronage, but little else. The major pre-FDR federal scandals were major largely because they were so sporadic — the Teapot Dome scandal would hardly raise an eyebrow today.

Once the federal government usurped state spending prerogatives, however, winning re-election became an exercise in placating certain monetary interests. Federal legislators were now expected to funnel cash from the federal coffers to local interests. The bile of corruption quickly seeped into the federal blood system

Misconduct at Justice Department isn’t always prosecuted

WASHINGTON — Dozens of Justice Department officials, ranging from FBI special agents and prison wardens to high-level federal prosecutors, have escaped prosecution or firing in recent years despite findings of misconduct by the department’s own internal watchdog.

Most of the names of the investigated officials, even the highest-ranking, remain under wraps. But documents McClatchy obtained under the Freedom of Information Act reveal for the first time a startling array of alleged transgressions uncovered by the department’s inspector general.

These include:

– Investigators concluded an assistant U.S. attorney “lacked candor” when interviewed by FBI agents investigating her husband’s “embezzlement activity.” The prosecutor also “made misleading and contradictory” statements to other investigators who were asking about her husband’s criminal activities. She was “verbally admonished” this year, but the Justice Department opted not to prosecute.

– A U.S. attorney violated federal laws and regulations by accepting a partially paid trip to a foreign country by a nonprofit organization, according to investigators. The unnamed presidential appointee was given a written admonishment and he was ordered to reimburse the organization. Prosecution was declined.

– Two FBI supervisory special agents accepted free tickets to the NBA All-Star Game and gave them to family members. One agent “lied under oath” about his actions, and was found to have misused government resources to “engage in extramarital affairs with three women.” That agent resigned after the bureau proposed his dismissal and the other was suspended for three days. Neither was prosecuted.

– An FBI assistant special agent in charge sexually harassed female subordinates, retaliated against a female special agent who refused to have a relationship with him and used his FBI-issued BlackBerry to pursue romantic relationships with 17 FBI employees, nine of whom were direct subordinates, as well as 29 other women. In January, the FBI told the inspector general it had issued an undisclosed disciplinary action. No charges were brought. In a statement to McClatchy, the FBI said it couldn’t comment on an “ongoing personnel matter.”

The records, which cover the period from January 2010 to March 2014, detail some 80 cases, only a few of which appear to have been previously made public. The accused officials work for agencies that include the Drug Enforcement Administration, the U.S. Marshals Service and the Bureau of Alcohol, Tobacco, Firearms and Explosives.

In at least 27 cases, the inspector general identified evidence of possible criminal wrongdoing but no one was prosecuted.

These previously undisclosed cases, and dozens of others like them reviewed by McClatchy, reveal more than an underside to federal law enforcement. The cases underscore how much discretion federal prosecutors have in deciding whether to press charges, and they raise questions about when and why this discretion is applied.

“I think it’s fair to ask why some of these cases weren’t prosecuted,” Justice Department Inspector General Michael E. Horowitz said in an interview. “That’s clearly a concern we have: To make sure there are not two standards of justice at the Department of Justice.”

However, he said it’s understandable in many cases that criminal charges aren’t filed. His office presents a case for prosecution in every instance where there’s “credible evidence that could support elements of a crime, even when it’s weak.”

“Some of them are just legitimately difficult cases,” he said.

The reports come, however, amid an overall decline in public corruption prosecutions during the Obama administration. So far this year, records obtained by the nonpartisan Transactional Records Access Clearinghouse at Syracuse University show that 34 percent of investigators’ referrals of public corruption allegations were accepted for prosecution.

During the George W. Bush presidency, records show, 41.6 percent of the official corruption referrals resulted in prosecution.

Gauging the reasons behind an individual prosecutor’s decision-making is nearly impossible, because the Justice Department and inspector general’s office won’t release most of the names or discuss the details of the cases.

Justice Department records show that federal prosecutors nationwide declined a total of 25,629 criminal matters during fiscal year 2013. The reasons most commonly reported included weak or insufficient evidence and lack of criminal intent.

Peter Carr, a Justice Department spokesman, said prosecutors followed federal rules when deciding whether to initiate or decline charges in a case.

Carr pointed to the U.S Attorney’s Manual, which says, “Federal law enforcement resources and federal judicial resources are not sufficient to permit prosecution of every alleged offense over which federal jurisdiction exists.”

“Public corruption cases are very fact-specific, and statistics fluctuate routinely year by year,” Carr said Tuesday. “The decision to bring a case involves a number of factors, all covered by the Principles of Federal Prosecution, which may include the seriousness of the allegation, the admissible evidence and whether there is a substantial federal interest in pursuing charges.”

The inspector general’s summary of unprosecuted cases was provided to Republican Sens. Charles Grassley of Iowa and Tom Coburn of Oklahoma, and independently obtained by McClatchy through a FOIA request.

Grassley said he agreed that not all cases warranted prosecution. However, he called for more transparency in the decisions “because of the obvious appearance of a conflict of interest.”
