It’s right there in the Constitution: “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law; and a regular Statement and Account of the Receipts and Expenditures of all public Money shall be published from time to time.”
Which is why this latest episode of lawlessness from the administration so particularly galling. “The U.S. Treasury Department has rebuffed a request by House Ways and Means Chairman Rep. Paul Ryan, R- Wis., to explain $3 billion in payments that were made to health insurers even though Congress never authorized the spending through annual appropriations,” The Washington Examiner’s Philp Klein reported on Thursday (http://www.washingtonexaminer.com/treasury-wont-explain-decision-to-make-3-billion-in-obamacare-payments/article/2560739).
That’s right. The payments insurers receive, dubbed “cost –sharing subsidies,” are designed to offset the costs incurred when they pick up the out-of-pocket expenses for low-income individuals covered by Affordable Care Act plans. If insurers had to cover these costs themselves, Obamacare would be infeasible. So, the federal government picks up the tab for the newly insured as they go about receiving “free” health care.
There’s just one tiny, unconstitutional problem: Congress never authorized the distribution of those funds. “[B]ut the Department of Health and Human Services, with the cooperation of the U.S. Treasury, made them anyway,” Klein reported.
In a Feb. 3 letter to Treasury Secretary Jack Lew, Ryan, along with House Energy and Commerce Committee Chair Rep. Fred Upton, R-Mich., asked for “a full explanation for, and all documents relating to” the administration’s decision to make the cost-sharing payments without congressional authorization.
In response, on Wednesday, the Treasury Department sent a letter to Ryan largely describing the program, without offering a detailed explanation of the decision to make the payments. The letter revealed that $2.997 billion in such payments had been made in 2014, but didn’t elaborate on where the money came from. Over the next decade, cost-sharing payments to insurers are projected by the Congressional Budget Office to cost taxpayers nearly $150 billion.

It would be nice but I'm surprised those types of payments wouldn't already be authorized under ACA anyway. But will he be impeached by the House? Highly unlikely. Would he be convicted by the Senate? Never. I still think it's a fools errand for the Republicans to talk impeachment well before Congressional investigations and the like at least until Congress, including the Democrats, starts to care about itself as an institution.

It would be nice but I'm surprised those types of payments wouldn't already be authorized under ACA anyway. But will he be impeached by the House? Highly unlikely. Would he be convicted by the Senate? Never. I still think it's a fools errand for the Republicans to talk impeachment well before Congressional investigations and the like at least until Congress, including the Democrats, starts to care about itself as an institution.
The mere fact that he is "untouchable" as far as impeachment goes points to the TRUTH of who and what he is! It also points to the power of the entity(globalist) that uses this puppet.
This attitude that one does not impeach because the deciding factor will never convict is also a sham. When government and the public start to agree that maintaining the Rule of Law is up for grabs and easily dismissed for convenience's sake the Republic is about to fall.
As of now we have a carefully controlled dictator implementing well organized agenda of destruction and change upon this nation.

This spring will mark the 800th anniversary of the signing of the Magna Carta, the landmark agreement by King John of England at Runnymede ceding certain rights to rebel barons. Liberty will have another chance to shine on Wednesday when the Supreme Court hears a case with momentous implications about another sort of executive power. In this instance, though, it is the rebels who have the royal name: King v. Burwell raises questions about how President Obama has enforced the ObamaCare law—or, more precisely, modified, delayed and suspended it.
This will be the third challenge to the Affordable Care Act to reach the court. But King is different. The law’s constitutionality was challenged in NFIB v. Sebelius, 2012, and the way certain regulations burden particular types of plaintiffs was addressed by Burwell v. Hobby Lobby last year. Now comes King, challenging the administration’s implementation of the law. Even though the ACA gives wide latitude to the executive branch over implementation, its most important parts—coverage rules, mandates and subsidies—were addressed by Congress with specific dates, formulas and other directions. None of these provisions has gone into effect as Congress designed, simply because the plan conflicted with the president’s political calculus.

King focuses on the subsidies that help people pay increased premiums, one ACA pillar that the administration has toppled. Because Congress couldn’t constitutionally command states to establish exchanges, it authorized these credits for people who buy insurance “through an Exchange established by the State.” If a state didn’t establish an exchange, its residents—who would instead use the federal exchange Healthcare.gov—wouldn’t be eligible for subsidies.
But a funny thing happened on the way to utopia: Only 14 states set up exchanges, meaning that the text of the law denied subsidies in nearly three quarters of the states. This result was untenable to an administration intent on pain-free implementation. And so the administration engaged in its own lawmaking process, issuing an Internal Revenue Service rule that nullified the relevant ACA provision, making subsidies available in all states.

King, which the Supreme Court is expected to decide in June, is thus about much more than interpreting statutory language or evaluating the “deference” that judges owe bureaucrats. It isn’t a technical debate over the finer points of administrative law; it is an existential one about the rule of law itself.
Chief Justice John Roberts (http://topics.wsj.com/person/R/John-Roberts/7417)was correct in 2012 when he wrote in the NFIB v. Sebelius decision that it isn’t the court’s role to “express any opinion on the wisdom of the Affordable Care Act.”
But he also correctly noted “the Framers created a Federal Government of limited powers, and assigned to this Court the duty of enforcing those limits.” The court’s duty is to be a bulwark against arbitrary rule.
This is especially true in disputes between the political branches; the judiciary thus provides the ultimate safeguard of the separation of powers. Or, as Justice Robert Jackson put it in the famous Youngstown case of 1952 that rebuked President Truman ’s unilateral seizure of steel mills: “With all its defects, delays and inconveniences, men have discovered no technique for long preserving free government except that the Executive be under the law, and that the law be made by parliamentary deliberations. Such institutions may be destined to pass away. But it is the duty of the Court to be last, not first, to give them up.”
The president has shown deliberate indifference toward the plain text of the law. The Supreme Court must strike down the IRS rule and confirm the principle that, like King John at Runnymede, all political leaders are bound by the rule of law.
Mr. Shapiro is a senior fellow in constitutional studies at the Cato Institute. Mr. Blackman is a constitutional law professor at the South Texas College of Law in Houston. They recently filed a brief on Cato’s behalf in King v. Burwell.

I've said the same many times, impeachment is not a 'tool' to get rid of a president whom's decisions one disagrees with. Heck, from the time he led the partisan push for Obamacare, there were many calling for his impeachment, when asked what he'd done 'illegally, silence.
Same with the pullout of Iraq. Legal if foreseeable in being wrong.
Executive orders within the scope of powers? Yep, for the most part.
However when Congress chooses by vote to not do what he believes should be done, usurping their powers? Pushing and hopefully the courts will step in and settle it.
When he takes legislation passed, Obamacare, and changes implementation dates, provides waivers, etc., outside of that legislation by executive orders? More than pushing it, which is part of what will be decided by SCOTUS ruling of King.
Now that it's been shown that Treasury has been paying insurance companies, though not budgeted, more than pushing and is prohibited by the Constitution, also going to be addressed by King.
Ordering ICE agents not to enforce the laws regarding 'deport/not deport' lists provided by the executive order, in spite of federal court order, usurpation of judicial powers.
The list of reasons to consider impeachment grows, whether or not it will come to that?

I'd add to that his public announcement / advance warning of his intention to withdraw all forces from Iraq, that giving a KNOWN ENEMY OF AMERICA ample opportunity to plan, plot in such a way that America and Western powers could hardly fail to be disadvantaged by it. To give an ENEMY such a tactical advantage, so blatantly ... does it get more impeachable than that ??

They know, any attempt to impeach Obama would instantly be the signal Obama wants, and needs, to declare Martial Law...as EVERY BLACK AMERICAN who voted for him several times, would take to the streets, to burn, kill, and destroy their own neighborhoods without any POLICE intervention, since Obama's own Police Force, from the Black Panthers would prevent REAL police officers from doing anything.

It would be nice but I'm surprised those types of payments wouldn't already be authorized under ACA anyway. But will he be impeached by the House? Highly unlikely. Would he be convicted by the Senate? Never. I still think it's a fools errand for the Republicans to talk impeachment well before Congressional investigations and the like at least until Congress, including the Democrats, starts to care about itself as an institution.
We are replaying the 1990s. Same accusations, same do nothing. Obama should be nailed and so should Hillary. Their are Constitutional and legal grounds for both. I won't hold my breath.
