A Southern California woman is out of a job and facing death threats after she used her cell phone to videotape an encounter with a homeowner over a Mexican flag flying in the homeowner’s front yard — and published the video on YouTube.
The woman, Tressy Capps, a political activist and a city council candidate in a town amid the Inland Empire’s endless suburbia, placed the video on YouTube on Aug. 11, 2014.
“Hello? Hi. Is that a Mexican flag in your front yard,” Capps asks, pleasantly enough, in the video.
The woman to whom she is speaking, Maria Banuelos, is standing behind a window. Banuelos doesn’t respond because she doesn’t speak English, reports CBS Los Angeles.
Undaunted, Capps continues.
“You know we live in America right?” Capps then says. “This is the United States. So, why are you flying a Mexican flag in your front yard?”
She then suggests that the woman behind the window “move to Mexico if you want to fly your Mexican flag.”
“Does that make sense?”
Capps also maintains in the video that the homeowners could face municipal fines for flying a Mexican flag in the United States. However, an attorney for Ontario, Calif. has since strenuously denied that assertion.
Banuelos’s husband, Sigifredo Banuelos, who does speak some English, said the homeowners fly the flag to celebrate their Mexican heritage. They also have an American flag, he noted.
“I don’t think it’s offensive because this flag doesn’t do anything,” he told CBS Los Angeles.
Obviously, the flag bothered Capps.
“I was offended,” she told the station. “I was pretty upset. But I couldn’t understand her.”
The YouTube video has become something of a viral sensation. It was been viewed over 165,000 times as of Friday night.
The results of the viral video have been highly adverse for Capps. Her employer, real estate giant Coldwell Banker, has sacked her.
“We do not tolerate discrimination of any kind,” Coldwell Banker spokesman David Siroty said in a statement obtained by Fox News Latino. “We hold our affiliated companies to high ethical standards. Each of our franchised companies is independently owned and operated and we fully support the local owner’s decision to disassociate this independent agent from the brokerage firm and, by extension, our franchise system.”
And then there are the death threats. “My life is being threatened and the business I built for 30 years has suffered over a flag video,” Capps wrote in a Facebook post. “My son is being bullied at school now and for that I am devastated.”
“[T]aking a position on an issue does not make me evil, racist or unethical if I disagree with your position,” she also wrote, according to Fox Latino.
Capps has since apologized for the incident, but the homeowners say they skeptical of her sincerity.

I love the American flag (I have 40' in my back yard) and feel that if you want to live in America then you should be proud our your new citizenship (if you are, in fact, a citizen). I think even if it had been a black woman doing it, it still would've played out about the same, and it's just plain stupid. Yeah, okay, the woman's an ass for making a youtube video of dressing down folks for expressing their love for their country of ancestry (Anybody with, say, an Irish flag? Maybe a German one?). I've seen plenty of Greek neighborhoods with the Greece flag flying proudly (Admittedly, I look for this... you get the best gyros there.). Putting up a flag for your ancestry isn't anti-american. Hell, aside from the Native Americans, we're all descended of other countries. Being proud of that ancestry is not a crime, nor should it be shamed.
However, losing you job for your private time youtube video is just fucking stupid, and helps to crush not only the Right to Privacy, but the Right of Free Speech. The whole point of the first amendment is to establish that we should not be under constant worry of saying the wrong thing, lest we be struck down by the authority, whether it be a company or the government.

The punishment was my main gripe. This PC crap has taken on a whole new dimension now with harsh punishments be set and very freely given.
I don't do u-tube, twitter and only very, very rarely post on Facebook. When I do its pretty generic stuff. My wife signed me up on Facebook about 7 years ago. I' ve post there I think 4 times total in 7 years.
And yes, Ive noticed far too many on the right have joined in the insanity. My take on that is ffkkk them too.

It's not about privacy it's what she did in a very public manner in a very public place when she works for a company where she is (one of) the faces of that type of firm. She still has her 1A rights but she doesn't have the privilege of working for any particular company.

It appears that the American Flag is properly elevated higher than the Mexican Flag, so I don't see the issue.
It's his yard and he can do what he wants in his yard, besides that he flew them both properly so this woman trying to bully them was way out of line.

Imagine a high-immigration neighbourhood, where the households in the area all (or mostly) decide to fly their own country's flags. And this, in a country that rightly feels a national pride in itself. I ask: when does such a right cease to be JUST that, and when does it become a case of political correctness and tolerance turned into an insult ?
How many of those flags is TOO many ? How do you determine a proper figure ?
Countries have a right to their own identities. Citizens of those countries have every right to be in an environment, within their countries, that they properly relate to. So if such a citizen, feeling pride in her own country, feels aggrieved by the incursive intrusion of a FOREIGN flag, isn't it reasonable to speak up against it, WITHOUT incurring a penalty for doing so ?

One must remember that embassies are property of the country they are in. Same as our embassies are world wide. We don't fly the Union Jack under the Stars and Stripes in London, we fly ONLY our flag. Embassies in the US are not technically on US soil and so flag rules don't apply.
Same with the UN, the UN is not US property.
And there is no law that says that a private citizen must also fly the US flag if they are going to fly a foreign flag.

US national pride is something that comes and goes as the mood fits. Oh sure after 911 everyone gathered around and chanted USA USA , but overall ? With the increasing spread of technology, we have been ceding more and more of our right to privacy. If she'd said it at a bar, that would've been okay? What about just talking with somebody about it on a street corner? They all public spaces, so why is only the internet now unprotected?
Again, she was an ass, on her own time, which should not carry the penalty of losing her livelihood.
Her job is to sell houses; she diminished her abilities in that respect by taking the actions she did. She also took the time to piss off a significant population of her's, and her employer's, possible clients.
And I disagree that due to technology we have been ceding our rights, we've only been eroding our perceived right of "privacy." It's just that our activities are now so easily published and made public by the prevalence of technology. She went even farther and published her own rant. The ramifications could have been the same if she was at a bar or yelling on the street corner, the internet hasn't changed anything except magnified her words. If she said it quietly then I'm sure nothing would have happened because she would not have created the public spectacle that she did.
There is no 1A or 4A violation here. Besides, she harmed her own livelihood whether or not she had been let go. She is likely an independent contractor who has even fewer work rights than an employee.

Her does her being an ass outside work where it has no effect on her job performance, have an effect on her job performance?
Her job performance is directly tied to her being able to get listings and/or her ability to her being able to attract potential buyers.
