the point of the lawsuit apparently hinges on the parents refusal to support her if she doesn't live at home while obeying their rules.


Both sides will be in court Tuesday. Rachel Canning wants the court not to emancipate her, because under the law, a parent has an obligation to support any child who cannot stand on his or her own financially.

I found this little tidbit scary. Just low long does New Jersey consider a parent financially responsible for their child's livelihood???

Other articles state that she's been accepted to college, but it appears her parents want her to go to a college she can commute to. There are younger siblings involved and presumably the parents don't want to spend all the college fees on one child.


She'd hate to live at my house. While we have co-signed loans for my two at college they know they will be taking them over when they graduate. There's no free ride over here.

Trigg. According to OBAMACARE. Parents may/should/must keep their children...up to 26 years old...on their Health Insurance policy.
This kind of thing is only the beginning for many.
Stupidity, and Ignorance, based on DEPENDENCE on No Personal Responsibility...is...exactly what Obama, and the Democrats hope to make for ALL OF AMERICA eventually.
It's a wonder the Supreme Court hasn't ruled with Obama, making children the PERMANENT dependents of their parents until they die.
After all. They can collect Welfare, Foodstamps, Social Security Disability, Medicaid, Unemployment, and FORCE You, and Me to pay for everything for the rest of their life....since that's the FAIR, LIBERAL, SOCIALIST, and COMMUNIST WAY FOR AMERICANS OF THE FUTURE.

I realize its a crazy thought, but maybe if the parents of the child in question raised their kid to be responsible....

Rachel Canning Loses Effort to Make Parents Pay High School Tuition



A New Jersey family court judge ruled today that Rachel Canning's parents do not have to pay her high school tuition after she sued them to cover her schooling and living costs.

The judge delayed a ruling on whether the parents must pay the 18-year-old student's college tuition while asking lawyers to consider whether it's wise to "establish precedent where parents live in fear of establishing rules of the house?"

The judge also denied her request for weekly allowance and additional financial support including attorney fees.

The next hearing is scheduled for April 22.

The New Jersey family was in court today with the teenage daughter facing off against her parents in a battle to get them to pay for her schooling and living costs even though she's 18.

Rachel Canning, who stared straight ahead for most of the hearing, is suing her parents in family court in Morristown, N.J., because she says they refuse to pay for her Catholic high school education and for college in the fall.

She claims that her parents, Sean and Elizabeth Canning, kicked her out of their Lincoln Park house when she turned 18 in October, which they deny. Dad Sean Canning says she left voluntarily because she didn't want to follow their house rules concerning curfew and chores.

"Private school, new car, college education; that all comes with living under our roof," he told ABC News station WABC-TV.

His lawyer, reading from a statement before the start of this afternoon's hearing, said the Cannings "are distraught that their oldest daughter feels that litigation is a better option than living together as a family."

"To be clear, my clients never abandoned nor abused their child and they have asked her to come home," Laurie Rush-Masuret said.

The judge said today that he wished more energy would be spent on reuniting the family than keeping it apart.

I think that is exactly what they are trying to do, maybe a little late since it seems like she's been spoiled up to this point.

They've taken a stand, live under our roof, with our rules or we're done.

The problem seems to lie with the lawyer who's family she's living with, since it is him who is footing her legal bill. She wouldn't have been able to take it this far if he wasn't egging her on and paying for this ridiculous lawsuit.

Without knowing all of the circumstances, we don't know for sure. A parent can teach a child the best measures of responsibility and still have them falter. They can teach them vehemently to never steal, and have it happen. Teach them to wait till marriage for sexual relations, and find out they didn't listen. Or give them various "rules", have the kid see others not have the same, and then said kid doesn't listen to rules and gets tossed out or moves out. It's not always the fault of parenting. Based solely on what I have read on various articles, I've yet to see a single thing pointing to the parents doing anything wrong. Hell, they even stated they just want their daughter back, but that she would need to follow their rules. I think that's understandable. The kid making demands, at her age, and for things she hasn't even approached yet, after apparently she moved out to not have to follow rules - sounds like she hasn't matured yet and has a long way to go. It could be potentially the parents, but I don't think we should make that leap without evidence. The judge has been in the best position to "judge" thus far and she ruled against the kid.
