Yesterday in a historic decision, Mexico’s Supreme Court determined that homophobic expressions were not protected under the freedom of speech laws of this country, and that the use of offensive terms like “maricon” or “puñal” could be reason for prosecution.
The ruling has been hailed as a landmark case in the long fight in defense of gay rights in Mexico. The case was brought up to the Supreme Court after a public dispute between two journalists from Puebla, Mr. Armando Prida Huerta and Mr. Enrique Nuñez Quiroz; the latter wrote an op-ed note saying that Prida Huerta was a “puñal” and that only “maricones”worked on Prida Huerta newspaper. (Both words are common use terms in Mexico to refer to gay males, usually in a derogatory way).
It was a split decision by 3-2 in which the Supreme Court “determined that homophobic expressions or in other words the frequent allegations that homosexuality is not a valid option but an inferior condition - constitute discriminatory statements even if they are expressed jokingly, since they can be used to encourage, promote and justify intolerance against gays. For this reason, the Chamber determined that the terms used in this specific case -- made up of the words "maricones" and "puñal" -- were offensive. These are expressions which are certainly deeply rooted in the language of Mexican society but the truth is that the practices of a majority of participants of a society cannot trump violations of basic rights."

Well, the tamales makers have decided gay rights trump freedom of speech. That very special protection for perverts should trump the freedom of speech by the majority!
