Hey, no bigs. It’s just a 100-year-old company and California’s only surviving cannery, a sustainable, family-owned operation employing 30 people. The Drakes Bay Oyster Company has been in a seven-year fight with the federal government and environmental groups over whether it’s 40-year lease would be renewed this week. The Lunny family, which owns the oyster farm, was among a group of families that sold their ranch lands to the National Parks Service in the 1970s to protect them from developers, with the understanding they would get 40-year-leases renewed in perpetuity. After buying and operating the oyster farm without incident— they were even featured as outstanding environmental stewards by the National Parks Service— the Lunnys learned in 2005 they were accused of bringing environmental damage to an area the NPS and environmentalists were anxious to designate as the nation’s first federally recognized marine wilderness.

Supporters of a Marin County oyster farmer claimed victory Tuesday after a panel of scientists concluded that National Park Service (http://www.sfgate.com/?controllerName=search&action=search&channel=bayarea&search=1&inlineLink=1&query=%22National+Park+Service%22) officials made errors, selectively presented information and misrepresented facts in a series of reports about his Drakes Bay shellfish operation.


The findings mark the second time in a year that the Park Service has been put under a spotlight for essentially fudging data in its attempts to show that the Drakes Bay Oyster Co. While the report did not specifically accuse anyone of misconduct, it raised serious questions about governmental misuse of scientific data.


"I find it troubling and unacceptable that the National Park Service exaggerated the effects of the oyster population on the ... ecosystem," U.S. Sen. A California family that has operated an oyster farm on the bucolic Northern California coast is fighting back after the federal government moved to kick it off of the National Park Service property where the shellfish have been legally harvested for nearly 80 years.
The Drakes Bay Oyster Company faces closure and its 30 employees will be out of work if the National Park Service reclaims some 1,100 acres of an estuary as part of a plan to create a larger marine wilderness preserve at Point Reyes National Seashore in Marin County. Owner Kevin Lunny said federal officials told him on Thursday — one day before his company's 40-year lease was set to expire — that he had three months to clear out. On Tuesday, he announced he's suing.
"We're not going to walk away," Lunny told reporters during a conference call. "We're fighting for our community."
Lunny said the company currently has roughly 10 million immature oysters worth up to $5 million awaiting harvest.
Lunny has an ally in Sen. Dianne Feinstein, D-Calif., who had tried to get the lease extended for another decade. But even her clout failed to sway U.S. Interior Secretary Ken Salazar.
“I am extremely disappointed that Secretary Salazar chose not to renew the operating permit for the Drakes Bay Oyster Company,” Feinstein said in a statement. “The National Park Service’s review process has been flawed from the beginning with false and misleading science, which was also used in the Environmental Impact Statement. The secretary’s decision effectively puts this historic California oyster farm out of business. As a result, the farm will be forced to cease operations and 30 Californians will lose their jobs.”
The National Park Service bought the land from Lunny's predecessor in 1972, but granted then-owner Johnson Oyster Company a 40-year lease to continue harvesting oysters. Salazar said in a department memo that it was made clear at the time of the lease's signing that it would not be renewed, and that the information was conveyed to Lunny in 2004 when he bought the business.
Salazar's move will effectively end the company’s operations within the national park estuary, which includes an onshore oyster processing plant and offshore oyster harvesting on more than 1,000 acres of coastal waters.

But more than that, the Government created a deal with those people in the 70s for their land.

Salazar is a mirror image of the entire Obama operation.

From top to bottom, they are corrupt.

At Lake Tahoe, some of those folks with cabins lease land from the Feds. They get 10 year leases. Naturally not owning the land, the cabins sell for super low prices. And of course nobody will build a super nice cabin there today. At one time, they would have. They no longer trust the Feds.

That is a con job. They most certainly did NOT deplete that bay. They farmed those oysters. They had them contained but exposed to ocean water. But those oysters got there because the family put them there.

Drakes Bay is not easy to get to. The road to it is very old and two laned. And very curvy. I doubt you can go much over 40 miles per hour. And for many miles, there is nothing to see. And if you need to see the ocean, it is easy to see at San Francisco and other places much easier to get too. No, those people got shit on by Obama. Make no mistake, Obama is Salazars' master.

If you are downtown SF and drive to Drakes Bay, it is 55 miles. And you can count on a drive of about 2 hours. And when you get there, as I have done, you see ocean. And not much else.

April obviously knows NOTHING about the shellfish industry... Growing up in a town known as OYSTER BAY, LONG ISLAND I will attempt to enlighten ...

Oyster farmers are among the most ecologically friendly business owners... they plant thousands and thousands of acres of seed beds annually so that they will always have good grounds to harvest. I have seen and been involved in many talks with the family that owns Frank Flowers and Son. Half the time they are on the water they are putting Oysters IN THE WATER... It's how they have stayed in business for about 100years!!

The bay isn't depleted....it's fully stocked for years.... the Feds just wanted to pull the plug on these people.

But...Obama has shown he would rather cave to the ECO-Freaks... instead of keeping Americans Working...

In specific reference to the estero lease, after the issuance of the attorney general's opinion and two weeks after these bills became law, dispositive contemporaneous execution of the statute occurred. My files contain an Oct. 22, 1965 letter from the director of the Department of Fish and Game to the superintendent of the Point Reyes National Seashore stating that since AB 1024 "reserved fishing rights to the state, (it) appears all state laws and regulations pertaining to shellfish cultivation remain in effect [and thus] are applicable to the Johnson Oyster Company." The letter requested a response. On March 25, 1966, Superintendent Leslie Arnberger responded: "This office is quite agreeable with (your) interpretation (and) should (the Regional office) conclusion be different, I will notify you promptly." There is no such notification.



All of this was confirmed by the National Park Service in a 1974 environmental review of possible wilderness status: "This is the only oyster farm in the Seashore, control of the lease, called a license at times, from the California Department of Fish and Game, with presumed renewal indefinitely, is within the rights reserved by the State."


It would seem that the law is on the side of the oyster company in this situation.

I can't remember how they get infant oysters, but they farm them. They install the infants onto something they can cling to. Those are not wild oysters taken from the Sea. Salazar is being an ass hole to shut them down. That area is remote. And damned few people with common sense even desire to go to that area.
