Somehow I think this story will not be reported in the liberal media. After all who are we to judge?
Kevin Clash -- the man known as the voice of Elmo -- has taken a leave of absence from Sesame Street in the wake of allegations he had a sexual relationship with a 16-year-old boy, TMZ has learned ... allegations Clash adamantly denies.
We've learned ... Sesame Workshop lawyers recently met with a 23-year-old man who claims he and Clash began a sexual relationship 7 years ago ... when he was 16 and Clash was 45.
Clash has acknowledged to TMZ he had a relationship with the young man -- but insists it only took place AFTER the accuser was an adult.
Sesame Workshop honchos tell TMZ ... "In June of this year, Sesame Workshop received a communication from a young man who alleged that he had a relationship with Kevin Clash beginning when he was 16-years-old. This was a personal relationship, unrelated to the workplace. We took the allegation very seriously and took immediate action."
Sesame Workshop officials acknowledge to TMZ they met with the accuser twice and had a number of other communications with him.
Sources with direct knowledge of the situation tell TMZ ... after the accuser's initial meeting with Sesame Street, the accuser felt Sesame Workshop's lawyers were trying to muzzle him ... so he lawyered up with Andreozzi and Associates -- the firm that represented one of the victims in the Jerry Sandusky child rape case.
On August 15, 2012 ... Andreozzi fired off a letter to Sesame, accusing the company of trying to "discredit the victim in order to protect its employee and the image of one of its most valuable characters," adding, "This approach places a greater value on a puppet than the well being of a young man."

The interest so far is encouraging. I see the Washington Post put it in the Entertainment Section and not on the front page or at least Section A.

Um, not to poke holes in this story, but even if the accuser WAS 16 at the time, in NY the age of consent is 16, not 18, and so, while embarassing, is still not illegal. Aside from that, it's just a pure battle of a person's word. It seems off to me, however, that he waited 7 full years before making the accusation.

I tend to agree about the time lapse, but do you feel the same about the Penn State victims waiting so long? Or the altar boys?

New York State law has recently changed. This does not effect the minimum requirement of 17, but does make some changes..
http://assembly.state.ny.us/cgi-bin/claws?law=82&art=29
2nd degree is now over 18 & under 15.
The below is also included in the second second. I'm assuming that what this says is similar to what used to be in section 1 about under 17 & over 21, or more than 4 years (15-20, etc). I'm not a lawyer, but this is what I can make from this.
1st degree is now under 11, or under 13 & over 18. You can confirm all of this from the law which is direct from NY State.
It shall be an affirmative defense to the crime of rape in the second degree as defined in subdivision one of this section that the defendant was less than four years older than the victim at the time of the act.
S 130.55 Sexual abuse in the third degree.
A person is guilty of sexual abuse in the third degree when he or she subjects another person to sexual contact without the latter`s consent; except that in any prosecution under this section, it is an affirmative defense that (a) such other person`s lack of consent was due solely to incapacity to consent by reason of being less than seventeen years old, and (b) such other person was more than fourteen years old, and (c) the defendant was less than five years older than such other person. Sexual abuse in the third degree is a class B misdemeanor.
S 130.40 Sodomy in the third degree.
A person is guilty of sodomy in the third degree when: 1. He or she engages in deviate sexual intercourse with a person who
is incapable of consent by reason of some factor other than being less than seventeen years old; 2. Being twenty-one years old or more, he or she engages in deviate sexual intercourse with a person less than seventeen years old; or 3. He or she engages in deviate sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent. Sodomy in the third degree is a class E felony.
S 130.25 Rape in the third degree.
A person is guilty of rape in the third degree when: 1. He or she engages in sexual intercourse with another person who is
incapable of consent by reason of some factor other than being less than seventeen years old; 2. Being twenty-one years old or more, he or she engages in sexual intercourse with another person less than seventeen years old; or 3. He or she engages in sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent. Rape in the third degree is a class E felony.

What is the Age of Consent for Sex in New York? In New York, the age of consent for sex is seventeen. This applies to men and women, and applies to both heterosexual and homosexual conduct.
However, as in many other states, New York has allowances for minors who are below the age of consent (but older than 13) and close to the same age. These provisions exist because age of consent laws are meant to prevent minors from being sexually exploited by adults, where there is almost always a significant power imbalance. It is not meant to punish individuals who are close to the same age for engaging in consensual, non-exploitative sexual conduct.
In New York, a person who is under age 16 but older than 13 years old can consent to sex with a person who is no more than 4 years older.
In New York, the crime of 3rd degree rape is committed when a person over the age of 21 has sex with a person under the age of 17. It can be punished by 4 years in prison. The punishments are far more severe when the victim is younger. If the victim is under 15, the punishment is up to 7 years in prison. A qualified New York lawyer (http://www.legalmatch.com/find/new-york-lawyers.html) can provide you more information if there is a legal basis for a case invovling non-consensual sexual contact.

That... is needlessly complex, and I doubt highly that many New Yorkers even understand the exact way the laws work on that.

But he's not accusing rape, which makes it a bit different here. He's accusing him of being in an inappropriate relationship, and if he felt it was rape, he would have called it that.

Well for all the complexity it seems age of consent is 17 and only with someone within 4 years of age.

Well, technically speaking, stautory rape laws exist because we deem certain ages too young to know enough to fight what is going on.

I believe it's 17 but a lesser offense if the victim is over 16. But for most purposes for sexual contact to be "legal", the person must be 17.

Here are the details
However, restraining the Court may prove more difficult than expected. Responding to criticism aimed at Sen. Rick Santorum (R-Pa.) over his conclusions that the Lawrence decision could lead to legalized pedophilia and other sexual acts, the Catholic Family Association of America (CFAA) pointed to a potential pedophilia advocate on the Court itself.
"Given that homosexual advocates are in a full court press to lower the age of consent as low as it can go, and pro-pedophile sitting Supreme Court Justice Ruth Bader Ginsburg 's documented advocacy of lowering the age of consent to 12 years old, parents should be horrified that there are so few politicians, like Sen. Santorum, actually defending the family," Timothy Chichester, CFAA president, said April 23 (http://www.cathfam.org/PR042303.html).
Chichester was referring to a paper authored by Ginsburg entitled "Sex Bias in the U.S. Code," which was prepared for the U.S. Commission on Civil Rights in April 1977
The allegation was further substantiated by Robert Knight, director of CWA's Culture Institute, in "Homosexual Behavior and Pedophilia," an article (http://us2000.org/cfmc/Pedophilia.pdf) he co-authored with the Family Research Council's Frank York.
"When U.S. Supreme Court Justice Ruth Bader Ginsburg was an attorney for the ACLU, she co-authored a report recommending that the age of consent for sexual acts be lowered to 12 years of age," the article points out.
Knight and York's footnoted documentation on this is as follows: "Sex Bias in the U.S. Code," Report for the U.S. Commission on Civil Rights, April 1977, p. 102, quoted in "Ruth Bader Ginsburg's Feminist World View," The Phyllis Schlafly Report, Vol. 26, No. 12, Section 1, p. 3. The paragraph (from the Ginsburg report) reads as follows: "'Eliminate the phrase "carnal knowledge of any female, not his wife, who has not attained the age of 16 years" and substitute a federal, sex-neutral definition of the offense. ... A person is guilty of an offense if he engages in a sexual act with another person. ... [and] the other person is, in fact, less than 12 years old.'"
LaRue said pedophiles may co-opt language used in the Lawrence decision regarding homosexuals; that laws against their behavior are a discriminatory attempt to harm them as a persecuted minority. And they will be supported, she claimed, by academia. http://cnsnews.com/node/5673

As is so often the case in these situations, a new victim emerges from the shadows.
Kevin Clash, the longtime voice and puppeteer behind “Sesame Street’s” Elmo character, resigned on Tuesday after a new allegation was made that he had underage sexual relationships.Announcing the decision with what he called a “very heavy heart,” Mr. Clash said in a statement, “Personal matters have diverted attention away from the important work ‘Sesame Street’ is doing and I cannot allow it to go on any longer. I am deeply sorry to be leaving and am looking forward to resolving these personal matters privately.”
His statement came at around the same time that a lawsuit was filed in federal court in New York accusing him of “sexual activity” with a 15-year-old.
