Embattled Attorney General Eric Holder today demanded The Daily Caller stop publishing articles about the growing calls in Congress for his resignation because of the failed Operation Fast and Furious gun-walking program.


As Holder’s aide was escorting the attorney general offstage following his remarks Tuesday afternoon at the White House, a Daily Caller reporter introduced himself and shook Holder’s hand. The reporter asked him for a response to the growing chorus of federal legislators demanding his resignation.


Holder stepped towards the exit, then turned around, stepped back toward the reporter, and sternly said, “You guys need to — you need to stop this. It’s not an organic thing that’s just happening. You guys are behind it.”
Holder then walked offstage without answering TheDC’s request for comment about calls for his resignation.

The irony is that Holder’s resignation would do more for Obama’s reelection chances than almost anything else that could happen, apart from the worst economy in decades suddenly growing wings. Hatred for Holder is visceral across the country. He represents the worst and most base aspects of this administration. So if he goes, and a new, cleaned-up attorney general replaces him, it defuses a powerful weapon the GOP is going to use against Obama in the fall. Yes, Holder is going to be a major issue in the election campaign. Holder stepping down would undo those plans. Those calling for his resignation (and make no mistake, he is unfit for the office) need to realize that whomever replaces him will share the same ideology that led to the Black Panther dismissal and mirandizing terrorists. Meet the new boss…

In the growing Fast and Furious scandal, Border Patrol Agent Brian Terry’s death in Peck Canyon, Arizona was previously described as a chance meeting that led to a firefight: an illegal alien “rip crew” working for the Sinaloa cartel was hoping to find other illegal aliens and to rob them at gunpoint. Instead, they stumbled across a Border Patrol unit and murdered Agent Terry.


Last week, the Washington Times offered a new version of the encounter: they reported that the rip crew was not hunting illegals, but Border Patrol teams — with the intention of engaging them in combat (http://www.washingtontimes.com/news/2011/nov/22/armed-illegals-stalked-border-patrol/).


Sources now tell PJ Media that neither version of events is accurate: the rip crew was not waiting for a chance encounter with other illegals, nor did the members intend to engage American law enforcement agents.
The rip crew was in Peck Canyon that evening with the intention of stealing money and drugs from a specific shipment of which they had prior knowledge.


Sources claim the Department of Justice has been trying for almost a year to hide the key information — how the rip crew knew the shipment was coming through that night.


Criminal informants (CIs) are a common tool of law enforcement agencies. When agencies apprehend criminals, agencies often reduce or drop charges in exchange for information leading to the arrests of higher-ranking criminals. Earlier this year, reports claimed that Operation Fast and Furious weapons smuggled over the border were actually chosen by an FBI informant, and paid for with money provided by the federal government.
The rip crew knew to be in Peck Canyon that December evening because a CI working for the FBI found out about a smuggling run — from the FBI...


The Drug Enforcement Administration (DEA) — through its own CIs and communications intercepts — was also aware of the planned assault.
Neither the DEA nor FBI warned Border Patrol about the expected criminal activity...


Deconfliction is a major element of high-risk undercover law enforcement work. Undercover agents and informants often cross jurisdictional paths, and deconfliction is the process whereby agencies warn off other agencies so that their assets don’t end up in conflict, putting investigations and lives at risk.


In this case, the FBI and DEA failed to deconflict. Neither agency bothered to warn Border Patrol to keep their BORTAC teams out of Peck Canyon that evening. As a direct result of this FBI and DEA failure — combined with Homeland Security forcing BORTAC units to carry less-lethal beanbag rounds in some of their primary weapons — Brian Terry’s under-armed four-man unit walked into an ambush against a heavily armed rip crew, at least five of whom were carrying rifles.


Brian Terry’s murder was entirely preventable. The incompetence of the DEA and FBI let his Border Patrol unit walk into an ambush. After the ambush, it appears the FBI tampered with evidence to cover up that one of their informants was involved with the murder of a federal agent.


The government has recently sealed the case (http://www.azcentral.com/news/articles/2011/11/10/20111110arizona-agent-brian-terry-case-sealed-federal-court.html) against the only suspect the FBI chose to keep behind bars.

Under fire for losing track of weapons that turned up at crime scenes along the Southwest border, the Justice Department has taken the extraordinary step of formally withdrawing an inaccurate letter about the episode that it sent to Congress earlier this year.


Deputy Attorney General Jim Cole sent nearly 1,400 pages of emails and other documents to Capitol Hill late Friday afternoon that lay bare the raw and sometimes cringe-worthy process by which the letter was drafted. The materials contain clues into how misleading information about the botched gun trafficking operation made it into a Feb. 4, 2011 letter to Congress that department leaders have since acknowledged was false.

Misleading Congress can be a prosecutable offense if a person who makes the statements knows they are false. But Attorney General Eric Holder has told lawmakers that so far he has no evidence anyone intended to deceive them. The matter remains under investigation not only by Republicans in Congress but also the Justice Department's inspector general...

...Dennis Burke, the former U.S. attorney for Arizona who resigned in August, pushed for a forceful response to Grassley's inquiry, at one point calling his staff "willing stooges for the Gun Lobby." Meanwhile, emails indicate that Justice Department officials looked to soften the language.

"Every version gets weaker. We will be apologizing...by tomorrow afternoon," wrote Burke.


A spokesperson for Grassley said Burke "personally apologized" for the tone of the emails after DOJ informed him they would be made public.


"The disparaging emails from Mr. Burke about Senator Grassley and his staff are disappointing from somebody who should have known much more about the gunwalking," said Beth Levine, Grassley's spokesperson. She added that the emails raise "even more questions" about the program and what various officials knew about it.
In a February letter sent to Grassley, the Justice Department claimed that the allegations that ATF let guns travel across the border were false.

"ATF makes every effort to interdict weapons that have been purchased illegally and prevent their transportation into Mexico," wrote Ronald Weich, assistant attorney general.

The Justice Department formally withdrew that letter Friday, saying it contained inaccurate information.


Top officials, including Assistant Attorney General Lanny Breuer, maintain they received inaccurate information in putting together the letter, but the source of the inaccuracies is not yet known. Burke maintained in one email that some of Grassley's questions were based on "categorical falsehoods." The Justice Department's inspector general is investigating where the information came form.


The emails will likely be a hot topic of conversation when Attorney General Eric Holder testifies before the House Judiciary Committee Thursday. Some Republicans have called for Holder to resign over the scandal, while he has maintained such gun walking programs are "fundamentally flawed."

But ATF whistleblowers told CBS News and Congress it was a dangerous practice called "gunwalking," and it put thousands of weapons on the street. Many were used in violent crimes in Mexico. Two were found at the murder scene of a U.S. Border Patrol agent.
